Please read these Terms and Conditions carefully before using this website or booking photography services with Dayna's Photography. By accessing or using our website or services, you agree to be bound by these terms. 

1. General Information

This website and the services offered are owned and operated by Dayna's Photography, a professional family photographer based in Perth.

These Terms apply to all website visitors, clients, and any other users of our services. If you do not agree to these Terms, please do not use our website or services.

2. Photography Services

Booking & Payment

• A non-refundable retainer (deposit) is required to secure your session date and time. The remaining balance is due before, as specified in your session agreement.

• Bookings are made on a first-come, first-served basis. Dates are not held without a retainer and signed agreement.

Cancellations & Rescheduling

• If you need to cancel or reschedule your session, please provide at least 48 hours' notice. Retainers may be transferred to a new date at the photographer’s discretion.

• In cases of inclement weather or illness (photographer or client), rescheduling will be arranged at no additional cost.

3. Image Delivery & Usage

• Edited digital images will be delivered via an online gallery within 6 weeks of the session date.

• You will receive high-resolution JPEG files for personal use only, unless commercial use rights are explicitly granted.

• Raw/unedited files are not provided.

Copyright & Usage

• All images remain the copyright of Dayna's Photography.

• Clients receive a personal-use license and may print and share their images for personal, non-commercial purposes.

• Images may not be altered, sold, or used for commercial purposes without written permission.

Photographer Portfolio Use

• With your written consent (via model release), your photos may be used on our website, social media, or marketing materials. This is optional and not required to book a session.

4. Client Responsibilities

• Please arrive on time for your session. Late arrivals may result in reduced session time without a reduction in fee.

• It is your responsibility to communicate any specific needs, preferences, or concerns before or during your session.

• Children must be supervised at all times during the session.

5. Website Use

You agree not to use this website for any unlawful purpose or to transmit any harmful content. Unauthorized use of this site or misuse of content, including images and text, may result in legal action.

6. Limitation of Liability

While we take great care in delivering professional and high-quality images, Dayna's Photography is not liable for:

• Delays in delivery due to technical issues or unforeseen events.

• Missed shots or uncooperative subjects.

• Loss or damage to digital files after they have been delivered and downloaded by the client.

In no event shall our liability exceed the amount paid for the session.

7. Third-Party Services

We may use third-party services (e.g., online galleries, payment processors). We are not responsible for the privacy practices or content of these external sites. Please review their respective terms and policies.

8. Changes to These Terms

We may update these Terms at any time without prior notice. Any changes will be posted on this page with an updated effective date. Your continued use of the website or services after changes are made constitutes your acceptance of the new terms.

9. Governing Law

These Terms are governed by the laws of the state/province of Western Australia, without regard to conflict of law principles.
